Criticism Mounts After Judge Rejects Federal Indictment Against Former President

United States: A judge on Monday rejected the federal indictment against former president Donald Trump for mishandling classified documents, in his second significant legal triumph in less than a month after the Supreme Court issued a decree regarding immunity.

The 93-page ruling of US District Judge Aileen M. Cannon, which stated that special counsel Jack Smith was improperly appointed, is now a success for Donald Trump, even if it is eventually reversed on appeal.

Trump’s lawyers have sought desperate judicial maneuvers to have this case dismissed before this ploy was executed, to great surprise.

Other courts have dismissed similar allegations to the one that Trump’s team used in the Florida case regarding the appointment of Smith.

It is very likely that the Justice Department will appeal the decision, and this matter might go to the Supreme Court. Thus, by throwing out the whole indictment list, Cannon’s decision also would result in the charges being dropped for Trump’s other two co-defendants, Waltine “Walt” Nauta and Carlos De Oliveira, as the Washington Post reported.

Even if Cannon does get overruled, the dismissal of Trump’s indictment contributes to his line of successes in the past several weeks, namely the Supreme Court ruling of July 1, which grants former presidents significant immunity for the actions committed in the course of their work during the presidency.

As for the Justice Department, Merrick Garland, the attorney general, did not speak on this decision. Said Smith spokesman, not in a hurry to have his say, either.

Statement by Trump

On Twitter and Facebook, Trump stated that Monday’s dismissal “should be just the first step” and that the remainder of the criminal and civil cases against him be dismissed, too,

He also accused Democrats of planning to bring the aforementioned cases against him, which have been further refuted by Federal, State, and local authorities.

He said, “Let us come together to END all Weaponization of our Justice System,” as the Washington Post reported.
