Lawsuit Against Musk’s USD 1 Million Giveaway

United States: Philadelphia’s district attorney has sued in an attempt to stop Elon Musk’s USD 1 million giveaways Tesla CEO Elon Musk is offering as part of his political organization campaign supporting presidential candidate Donald Trump.

After the America PAC’s sweepstakes offering USD 1 million every day until November 5 for a registered voter in a battleground state who has signed a petition in support of the Constitution, the first legal suit filed is that brought by Democratic District Attorney Larry Krasner

Krasner’s office added that the lawsuit does not rule out criminal action and was filed just over a week before the Election.

According to a statement from Krasner’s office, “The Philadelphia District Attorney is charged with protecting the public from public nuisances and unfair trade practices, including illegal lotteries. The DA is also charged with protecting the public from interference with the integrity of elections,” AP News reported. 

The America-supporting PAC for the billionaire tech magnate was e-mailed for comment on the legal action and asked if the cash inducements would persist and was linked to an X post of the newest USD 1M winner holding an oversized check. 

Even before the lawsuit was filed, election law experts asked questions pointing to the fact that it is against federal law for any person to provide any inducement to vote or register to vote. 

The problem, they argue, is that to win this award, the contestants need to be registered to vote in one of several ‘swing’ states. Musk has portrayed money as something that has to be won, as well as wages for being a mouthpiece of the group. 

However, this lawsuit will help clarify that it’s not vote buying to which it refers. However, according to the DA, the case concerns running of lottery only. 

The suit added, “This case is very simple because America PAC and Musk are indisputably violating Pennsylvania’s statutory prohibitions against illegal lotteries and deceiving consumers,” AP News reported. 

It said examples of deception include not providing a complete set of contest rules, which include odds of winning and details on how winners are selected.
