US is safe from Immigrants! Court Slams Biden’s Controversial Plan

United States: The Biden administration has faced legal challenges with regard to the provision of providing citizenship to spouses of some of the illegal immigrants in the US by a federal judge pursuant to a lawsuit filed by sixteen states led by Republicans. 

The US District Judge J. Campbell Barker on Monday blocked the “parole in place” program that was initiated in June and which would permit illegal spouses of US citizens to gain humanitarian parole and a green card without leaving the country. 

States against the rule 

According to FOX News reports, the sixteen states represented by Texas and America First Legal filed a lawsuit stating that the rule violates the existing federal law, which disallows unauthorized immigrants from gaining immigration benefits like permanent residence before they have left the country and were readmitted again, as Fox News reported. 

The states argued that the rule does make unlawful use of parole, which is limited to use on a “case-by-case basis for urgent humanitarian reasons or significant public benefit.”

The Texas Attorney General Ken Paxton said, “Biden’s unconstitutional scheme would have rewarded over 1 million illegal aliens with the opportunity for citizenship after breaking our country’s laws—and incentivized countless more.” 

“This is just the first step. We are going to keep fighting for Texas, our country, and the rule of law. Great to work together with America First Legal, Stephen Miller, and our partner states,” he continued. 

According to Stephen Miller, president of AFL, “This is a huge victory in our courtroom battle to block the Biden-Harris executive fiat giving over 1 million illegal aliens a path to U.S. citizenship. That executive decree is now frozen. America First Legal is deeply honored to partner with Attorney General Paxton, [Idaho] Attorney General [Raul] Labrador, along with 14 other states to fight this unconstitutional mass amnesty,” as Fox News reported. 

Implications of the proposed rule 

Given how the administration had predicted this move would directly affect almost 500,000 immigrants and about 50,000 children. 

The new process would have applied to noncitizen spouses who have resided in the US since June of the year 2010 and who meet certain eligibility criteria to ensure that the proposed spouse will not pose any threat to American society and or its security in an endeavor to be granted an immigrant visa. 

It was also argued that families living in fear “face deep uncertainty about their future” because of the requirement to depart. 

“In addition, individuals must have no disqualifying criminal history or otherwise constitute a threat to national security or public safety and should otherwise merit a favorable exercise of discretion,” according to a fact sheet. 

Its duration is two weeks, although one can prolong the stay if he or she wishes. Barker is a Trump nominee judge. 

“The claims are substantial and warrant closer consideration than the court has been able to afford to date,” he said.
